Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This thesis aims to analyze the legal reasoning present in the judgment issued in criminal case No. 09334-2022-00321, processed before the Criminal Judicial Unit of the Pedro Carbo canton, in the province of Guayas. Reasoning, understood as one of the fundamental pillars of due process, guarantees that judicial decisions respond to a logical, transparent, and legally sound structure. Throughout this research, a descriptive qualitative methodology was applied, which allowed for the evaluation, through properly structured instruments, of whether the judgment meets the minimum standards of reasoning in terms of its sufficiency and correctness. The results obtained reveal certain shortcomings in the argumentative structure of the judgment, prompting reflection on the quality of judicial decisions and their impact on the rights of the parties. In addition, it was examined whether the case generated the filing of horizontal or vertical appeals.
