Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This thesis project analyzes the relevance of motivation in the judgments issued by first-level judges in Ecuador, considering its impact on the guarantee of due process and the legitimacy of the judicial system. Through a qualitative methodology, based on documentary analysis and interviews with justice system professionals, the most recurrent deficiencies in the motivation of judicial decisions are identified, such as the lack of legal foundation and insufficient factual argumentation. The results demonstrate the need to strengthen the technical and ethical capacities of judges, as well as to promote a culture of judicial motivation that guarantees transparent, coherent decisions that respect fundamental rights. The study proposes practical guidelines aimed at improving the quality of judgments and contributing to the institutional strengthening of the Ecuadorian Judiciary, reaffirming motivation as an essential pillar of the constitutional state of rights and justice.
