Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract: The central theme of this thesis is the motivation behind the judgments issued by first-level judges in Ecuador, a principle that constitutes a fundamental guarantee of due process. This principle requires that the judge justify their decision with a coherent and sufficient factual and legal foundation, detailing the reasons that support the ruling. The research analyzes a specific judgment in case No. 18331-2024-00200, for a traffic offense with property damage. The judge of the Baños judicial unit ratified the defendant's innocence. The motivation for this decision was based primarily on the comprehensive reparation agreement reached by the parties and the insufficiency of evidence to prove the materiality of the information or criminal responsibility. This was supported by the breathalyzer test, which yielded a negative result. This study also seeks to evaluate the quality of judicial motivation regarding the importance of road safety.
