dc.descriptionResumen:La investigación analiza la estabilidad laboral reforzada de las personas con discapacidad en Ecuador. Su objetivo general fue examinar los obstáculos que dificultan su aplicación práctica en los sectores público y privado, mientras que los objetivos específicos se orientaron a estudiar su fundamento y valorar los criterios desarrollados por la Corte Constitucional. El problema central radica en la distancia entre el amplio reconocimiento normativo de esta protección y su cumplimiento real, especialmente frente a contratos ocasionales, nombramientos provisionales, supresión de puestos, despidos intempestivos, falta de ajustes razonables y ausencia de procesos de reubicación. La investigación siguió un enfoque cualitativo, con diseño no experimental y bibliográfico-documental; se aplicaron los métodos analítico-sintético, hermenéutico-jurídico, dogmático-jurídico y jurisprudencial mediante la revisión de normas, doctrina y sentencias constitucionales. Los resultados muestran que la estabilidad reforzada exige valorar ajustes razonables y medidas de reparación. Se concluye que la desvinculación solo resulta compatible con la Constitución cuando existe una causa objetiva y la decisión se encuentra debidamente fundamentada, aunque su eficacia todavía depende de protocolos internos claros y de una aplicación uniforme por empleadores, instituciones y jueces.es_ES
dc.description.abstractAbstract: This research analyzes the enhanced job security afforded to persons with disabilities in Ecuador. Its general objective was to examine the obstacles hindering the practical application of this protection in both the public and private sectors, while specific objectives focused on studying its legal basis and evaluating the criteria established by the Constitutional Court. The core issue lies in the gap between the extensive legal recognition of this protection and its actual implementation particularly regarding casual contracts, provisional appointments, position eliminations, abrupt dismissals, the failure to provide reasonable accommodations, and the absence of reassignment processes. The study employed a qualitative approach with a non-experimental, bibliographic-documentary design, utilizing analytical-synthetic, legal-hermeneutic, legal-dogmatic, and jurisprudential methods through a review of regulations, legal doctrine, and constitutional rulings. The results indicate that enhanced job security requires the consideration of reasonable accommodations and reparation measures. The study concludes that termination of employment is consistent with the Constitution only when there is an objective cause and the decision is duly substantiated, although its effectiveness still depends on clear internal protocols and consistent application by employers, institutions, and the judiciary.es_ES
