dc.descriptionResumen:El presente trabajo investigativo sistematiza la vulneración de la presunción de inocencia, en el Ecuador por la aplicación de la prisión preventiva de manera indiscriminada, sin respetar los requisitos establecidos en el Art. 534 del COIP. La aplicación de esta medida de carácter personal, sin que se cumplan los estándares establecidos violenta el derecho a la libertad de las personas, y contribuye al hacinamiento carcelario en el país. Durante los últimos años el Gobierno Nacional ha declarado la guerra interna para combatir el crimen organizado, sin embargo esta declaratoria ha dado luz verde para que existan violaciones de los Derechos constitucionales como: la libertad, presunción de inocencia y se convierte en una pena anticipada, varios jueces que han dispuesto medidas diferentes a la prisión preventiva han sido sancionados con procesos disciplinarios del Consejo de la Judicatura, o incluso han sido destituidos, violentando también la independencia de poderes del Estado en el Ecuador. El trabajo demuestra, a través del análisis de la normativa jurídica nacional e internacional y la jurisprudencia constitucional y convencional, las violaciones al derecho a la presunción de inocencia producidas en el período estudiado.es_ES
dc.description.abstractAbstract:This research study systematizes the violation of the presumption of innocence in Ecuador resulting from the indiscriminate application of pretrial detention, without adhering to the requirements established in Article 534 of the COIP (Comprehensive Organic Criminal Code). The application of this personal restrictive measure without meeting established standards infringes upon individuals' right to liberty and contributes to prison overcrowding in the country. In recent years, the National Government has declared an internal war to "combat" organized crime; however, this declaration has paved the way for violations of constitutional rights such as liberty and the presumption of innocence effectively turning pretrial detention into a form of anticipatory punishment. Furthermore, judges who have ordered measures other than pretrial detention have faced disciplinary proceedings by the Judicial Council or have even been removed from office, thereby also undermining the separation of powers within the Ecuadorian state. Through an analysis of national and international legal frameworks, as well as constitutional and conventional jurisprudence, this study demonstrates the violations of the right to the presumption of innocence that occurred during the period under review.es_ES
