dc.descriptionResumen:La presente investigación tuvo como objetivo analizar los nuevos criterios adoptados por la Fiscalía General del Estado en la aplicación del delito de terrorismo y su incidencia en el respeto de las garantías del debido proceso en el sistema penal ecuatoriano durante el período 2023 2025. Para ello, se desarrolló un estudio jurídico y cualitativo sustentado en el análisis de la normativa penal y constitucional vigente, documentos institucionales de la Fiscalía General del Estado, doctrina especializada y jurisprudencia de la Corte Constitucional del Ecuador. Los resultados evidencian que la utilización de criterios expansivos en la calificación del delito de terrorismo puede generar tensiones con principios fundamentales del debido proceso, especialmente en relación con la legalidad, la presunción de inocencia, la proporcionalidad y el derecho a la defensa. Asimismo, se identificó que la amplitud interpretativa del tipo penal y el contexto de fortalecimiento de las políticas de seguridad influyen directamente en la actuación fiscal. El estudio aporta elementos de análisis que contribuyen a fortalecer la seguridad jurídica y a promover una aplicación del derecho penal compatible con los estándares constitucionales vigentes.es_ES
dc.description.abstractAbstract: This research aimed to analyze the new criteria adopted by the State Attorney General's Office regarding the application of the crime of terrorism and their impact on respect for due process guarantees within the Ecuadorian penal system during the 2023 2025 period. To this end, a qualitative legal study was conducted, grounded in an analysis of current criminal and constitutional regulations, institutional documents from the State Attorney General's Office, specialized legal doctrine, and jurisprudence from the Constitutional Court of Ecuador. The results demonstrate that the use of expansive criteria in classifying the crime of terrorism can create tensions with fundamental due process principles particularly regarding legality, the presumption of innocence, proportionality, and the right to a defense. Furthermore, the study identified that the broad interpretative scope of the criminal offense and the context of strengthening security policies directly influence prosecutorial actions. The study provides analytical insights that contribute to strengthening legal certainty and promoting an application of criminal law that aligns with current constitutional standards.es_ES
