dc.descriptionResumen:La presente investigación examina la prisión preventiva como medida cautelar desproporcionada frente a investigaciones penales incompletas dentro del sistema procesal ecuatoriano durante 2023-2024, toda vez que se advierte una tendencia reiterada a disponerla sin que concurran elementos de convicción suficientes que justifiquen la restricción de la libertad personal, para lo cual se emplea un enfoque cualitativo y descriptivo que articula el análisis doctrinario, normativo y jurisprudencial, considerando los principios constitucionales, la Constitución de la República, el Código Orgánico Integral Penal y los criterios de la Corte Constitucional del Ecuador y la Corte Interamericana de Derechos Humanos, de cuyo desarrollo se colige que su imposición en escenarios de deficiencia investigativa desnaturaliza la finalidad cautelar y la transmuta en sanción anticipada, vulnerando la libertad personal, la presunción de inocencia y el debido proceso, agravado por la falta de motivación reforzada y la escasa eficacia del control periódico, por lo que se concluye que su aplicación debe sustentarse en elementos de convicción suficientes, motivación sólida y control permanente, proponiéndose lineamientos orientados a una práctica judicial más garantista y proporcional.es_ES
dc.description.abstractAbstract:This research examines pretrial detention as a disproportionate precautionary measure in the context of incomplete criminal investigations within the Ecuadorian procedural system during 2023 2024. It notes a recurring tendency to order such detention without sufficient evidentiary grounds to justify the restriction of personal liberty. The study employs a qualitative and descriptive approach, integrating doctrinal, legal, and jurisprudential analysis while considering constitutional principles, the Constitution of the Republic, the Comprehensive Organic Penal Code, and the criteria established by the Constitutional Court of Ecuador and the Inter-American Court of Human Rights. The analysis concludes that imposing pretrial detention amidst investigative deficiencies subverts the measure's precautionary purpose, transforming it into a form of anticipatory punishment that violates personal liberty, the presumption of innocence, and due process a situation exacerbated by a lack of heightened reasoning and the limited effectiveness of periodic reviews. Consequently, the study asserts that the application of pretrial detention must be grounded in sufficient evidence, robust legal reasoning, and continuous oversight, and it proposes guidelines aimed at fostering a judicial practice that better upholds rights and proportionality.es_ES
