| Abstract: | Abstract: This research analyzes the reasoning behind judgments issued by trial-level judges in Ecuador to determine whether they meet constitutional due process requirements. Judgment No. X-XXXXXX, issued on April 27, 2021, by Judge Ángel Daniel Pulluquitin Ramón, was used as a case study. The study employed a qualitative approach, utilizing specific guidelines for analyzing judicial reasoning to evaluate standards of sufficiency and correctness, in accordance with Article 76, numeral 7, letter l) of the Constitution of the Republic of Ecuador. The results demonstrate that the judgment presents adequate, clear, and coherent reasoning regarding both factual and legal aspects. The judge provided a logical basis for the decision, relying primarily on Article 25 of the Organic Law on Humanitarian Support and relevant Constitutional Court jurisprudence. No defects in reasoning (such as absence, insufficiency, or merely apparent reasoning) were detected, reflecting a proper application of legal argumentation. It is concluded that this judgment serves as a positive example of judicial reasoning and respect for due process. |
| Description: | Resumen:La presente investigación analiza la motivación de las sentencias emitidas por jueces de primer nivel en Ecuador, con el fin de verificar si cumplen con las exigencias constitucionales del debido proceso. Se utilizó como caso de estudio la Sentencia No. X-XXXXXX, emitida el 27 de abril de 2021 por el juez Ángel Daniel Pulluquitin Ramón. El estudio, de enfoque cualitativo, aplicó guías específicas de análisis de motivación judicial para evaluar los estándares de suficiencia y corrección, conforme al artículo 76 numeral 7 literal l) de la Constitución de la República del Ecuador. Los resultados demuestran que la sentencia presenta una motivación adecuada, clara y coherente, tanto en el aspecto fáctico como normativo. El juez fundamentó su decisión de forma lógica, apoyándose principalmente en el artículo 25 de la Ley Orgánica de Apoyo Humanitario y en jurisprudencia relevante de la Corte Constitucional. No se detectaron vicios de motivación (inexistencia, insuficiencia o aparente), lo que refleja un correcto uso de la argumentación jurídica. Se concluye que esta sentencia constituye un referente positivo de motivación judicial y respeto al debido proceso. |
