dc.descriptionResumen:La ejecución de la sentencia ejecutoriada es el mecanismo para que el acreedor que ha obtenido una decisión judicial a su favor persiga coercitivamente el cumplimiento de la obligación impuesta al ejecutado, cuando se ha negado a cumplirla voluntariamente. La ejecución es parte de la tutela judicial efectiva, pues permite materializar la protección a los derechos de los justiciables de manera práctica. En este trabajo se hace un estudio comparativo del ordenamiento jurídico vigente en Ecuador y en Colombia respecto a la ejecución, estableciendo la existencia de similitudes respecto del desarrollo del procedimiento, las medidas que se dictan en su sustanciación y diferencias importantes en cuanto a la efectividad de los mecanismos coercitivos empleados por los jueces. Se establecieron vacíos legales en la normativa ecuatoriana que demandan una armonización y reforma para viabilizar el cumplimiento de los fines de la ejecución, garantizando la tutela judicial a los ejecutantes. La investigación es de tipo jurídico documental, de derecho comparado; está sustentada en el análisis doctrinal y jurídico que permitió arribar a conclusiones y recomendaciones puntuales sobre la problemática investigada.es_ES
dc.description.abstractAbstract: The enforcement of a final judgment is the mechanism by which a creditor who has obtained a favorable court ruling can coercively pursue the fulfillment of the obligation imposed on the judgment debtor, when the latter has refused to comply voluntarily. Enforcement is an integral part of the right to effective judicial protection, as it allows for the practical realization of the protection of litigants' rights. This study conducts a comparative analysis of the legal frameworks in Ecuador and Colombia regarding enforcement, identifying similarities in procedural development and the measures ordered during proceedings, as well as significant differences regarding the effectiveness of the coercive mechanisms employed by judges. Legal gaps were identified in Ecuadorian regulations that require harmonization and reform to facilitate the achievement of enforcement objectives and guarantee effective judicial protection for judgment creditors. This research is a documentary legal study based on comparative law; it relies on doctrinal and legal analysis to reach specific conclusions and recommendations regarding the issue under investigation.es_ES
