dc.descriptionResumen:El presente proyecto investigativo denominado Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador analiza la calidad argumentativa de las decisiones judiciales, tomando como caso de estudio la sentencia No. 09209-2025- XXXXX, emitida por la Unidad Judicial de Familia, Mujer, Niñez y Adolescencia de Guayaquil. La investigación se centra en determinar si la resolución cumple con los estándares de motivación suficiente y correcta, conforme a la Constitución y la jurisprudencia constitucional ecuatoriana. Para ello, se aplicó el método analítico, que permitió descomponer la sentencia en sus elementos estructurales, identificando los hechos relevantes, el problema jurídico, las premisas normativas y fácticas. Asimismo, se examinó la aplicación del principio del interés superior del niño y la fijación de la pensión alimenticia mediante acuerdo conciliatorio. Los resultados evidencian que la sentencia respeta las garantías del debido proceso y fundamenta su decisión en normas constitucionales y legales pertinentes. En conclusión, el estudio aporta criterios para fortalecer la motivación judicial en el ámbito ecuatoriano y promueve mejoras en la práctica jurisdiccional y en la tutela judicial efectiva de derechos.es_ES
dc.description.abstractAbstract: This research project, titled "Reasoning in Judgments Issued by First-Instance Judges in Ecuador," analyzes the quality of argumentation in judicial decisions, using Judgment No. 09209-2025-XXXXX issued by the Judicial Unit for Family, Women, Children, and Adolescents in Guayaquil as a case study. The research focuses on determining whether the ruling meets the standards for sufficient and proper reasoning, in accordance with the Constitution and Ecuadorian constitutional jurisprudence. To this end, an analytical method was applied, allowing the judgment to be broken down into its structural elements and identifying the relevant facts, the legal issue, and the normative and factual premises. Additionally, the study examined the application of the principle of the best interests of the child and the determination of child support through a settlement agreement. The results demonstrate that the judgment upholds due process guarantees and bases its decision on relevant constitutional and legal provisions. In conclusion, the study offers criteria to strengthen judicial reasoning within the Ecuadorian context and promotes improvements in judicial practice and the effective judicial protection of rights.es_ES
