| dc.description | Resumen:El presente trabajo nos proporciona un enfoque reflexivo y analítico sobre las dificultades que surgen a raíz de la falta de motivación en los fallos judiciales dictados por los jueces de primera instancia en Ecuador, centrándose en el análisis de una sentencia penal sobre tráfico ilícito de sustancias catalogadas sujetas a fiscalización, dentro del proceso 17283-2018- 01478, en el que se demuestra que la decisión del juez satisface los criterios de motivación necesarios para verificar su legalidad, coherencia y claridad, según lo estipula y exige la Constitución de la República del Ecuador y sus otras leyes aplicables. Igualmente, no se detectaron fallas motivacionales como la incoherencia, la incongruencia, la inatinencia o la incomprensibilidad, ya que el juez aplicó bien las normas fundamentó los hechos comprobados, además de que existía una lógica entre el fallo final y la resolución, la relación lógica entre hechos, normativas y conclusión muestra que la sentencia cuenta con motivación, se garantiza la validez procesal de la resolución, se simplifica su supervisión en niveles superiores se refuerza la efectividad de las garantías jurisdiccionales que establece el ordenamiento constitucional. | es_ES |
| dc.description.abstract | Abstract:This study offers a reflective and analytical perspective on the difficulties arising from inadequate reasoning in judgments issued by courts of first instance in Ecuador. It focuses on the analysis of a criminal judgment regarding the illicit trafficking of controlled substances specifically within case file 17283-2018-01478 demonstrating that the judge s decision meets the reasoning criteria necessary to verify its legality, coherence, and clarity, as stipulated and required by the Constitution of the Republic of Ecuador and other applicable laws. Furthermore, no reasoning defects such as incoherence, inconsistency, irrelevance, or incomprehensibility were detected; the judge correctly applied the legal standards and substantiated the proven facts. The logical connection between the final ruling and the decision as well as the relationship between the facts, legal provisions, and the conclusion demonstrates that the judgment is properly reasoned. This ensures the procedural validity of the decision, facilitates its review by higher courts, and reinforces the effectiveness of the jurisdictional guarantees established by the constitutional legal framework. | es_ES |
