dc.descriptionResumen:El presente análisis de sentencia tiene como objetivo identificar el proceso penal en los delitos de tránsito, que son provocados por accidentes de tránsito, y abarca el análisis de los distintos medios de prueba indispensables además de examinar el procedimiento ordinario, estos accidentes se deben a la vulneración del deber objetivo de cuidado, por imprudencia, negligencia, impericia o inobservancia del conductor, pasajero o peatón, se analizará la sentencia por el delito de muerte causada por conducir en estado de embriaguez, tipificado en el artículo 376 del Código Orgánico Integral Penal, en este tipo de delitos es fundamental determinar la causa concurrente y la causa basal, con el afán de que el juzgador pueda determinar la culpabilidad o inocencia de una persona procesada, tomando en cuenta que el fiscal es quien dirige la investigacion pre procesal y procesal, dándole al juzgador elementos de convivio para individualizar la conducta culposa y establecer un nexo causal entre la conducta y el resultado dañoso, bajo esta línea este tipo de procesos deben ser rápidos y eficaces garantizando el derecho a la defensa y la tutela judicial efectiva.es_ES
dc.description.abstractAbstract: This analysis aims to examine the criminal proceedings associated with traffic offenses resulting from accidents. It covers the analysis of essential forms of evidence and the standard procedural steps. These accidents stem from a breach of the objective duty of care whether through recklessness, negligence, lack of skill, or non-compliance with regulations on the part of the driver, passenger, or pedestrian. The analysis focuses on a judgment regarding the offense of causing death while driving under the influence of alcohol, as defined in Article 376 of the *Código Orgánico Integral Penal* (Comprehensive Organic Penal Code). In such cases, it is crucial to distinguish between the concurrent cause and the root cause to enable the judge to determine the guilt or innocence of the accused. This process relies on the prosecutor who directs both the preliminary and formal investigations to provide the judge with the necessary elements to identify the specific culpable conduct and establish a causal link between that conduct and the harmful outcome. Accordingly, these proceedings must be swift and effective, ensuring the right to a defense and the right to effective judicial protection.es_ES
