dc.descriptionResumen:El derecho a la defensa en el proceso judicial constituye una garantía fundamental e irrenunciable que asegura un juicio justo y la igualdad de oportunidades entre las partes. En el Estado constitucional de derechos y justicia, la motivación de las decisiones judiciales se erige como un elemento esencial, no solo como exigencia formal, sino como una garantía sustancial que permite verificar que las resoluciones se fundamentan en razones claras, lógicas y jurídicamente válidas. La Constitución del Ecuador exige que toda decisión jurisdiccional esté debidamente motivada. El presente trabajo analiza una sentencia, con el objetivo de determinar si se ha cumplido con el estándar de motivación adecuada. Para ello, se emplean los métodos histórico-lógico y bibliográfico, que permiten identificar posibles deficiencias en la fundamentación jurídica y su impacto en el derecho a la defensa. La investigación evidencia que la ausencia o insuficiencia de motivación afecta el debido proceso, la seguridad jurídica y la confianza en la administración de justicia. En consecuencia, una resolución inmotivada deviene en arbitraria y puede acarrear su nulidad, al impedir el control y la impugnación efectiva de las decisiones judiciales.es_ES
dc.description.abstractAbstract: The right to a defense in judicial proceedings constitutes a fundamental and inalienable guarantee that ensures a fair trial and equality of opportunity between the parties. In a constitutional state based on rights and justice, the reasoning behind judicial decisions stands as an essential element not merely a formal requirement, but a substantive guarantee that allows for verification that rulings are grounded in clear, logical, and legally valid reasons. The Constitution of Ecuador mandates that every judicial decision be duly reasoned. This study analyzes a specific judgment to determine whether the standard for adequate reasoning has been met. To this end, historical-logical and bibliographic methods are employed to identify potential deficiencies in the legal reasoning and their impact on the right to a defense. The research demonstrates that the absence or insufficiency of reasoning undermines due process, legal certainty, and public confidence in the administration of justice. Consequently, a decision lacking reasoning becomes arbitrary and may be rendered void, as it precludes effective oversight and the challenging of judicial rulings.es_ES
