dc.descriptionResumen:La presente investigación aborda el análisis de la motivación suficiente y adecuada en la sentencia emitida dentro del proceso No. 17113-2022-XXXXX, vinculado a una acción de hábeas corpus por supuesta expiración de la prisión preventiva en Ecuador. El objetivo de la investigación consistió en analizar y evaluar la motivación judicial contenida en la referida resolución, con el fin de corroborar si satisface los principios constitucionales del debido proceso y la tutela legal efectiva. La indagación se realizó en el contexto del sistema judicial ecuatoriano, empleando como unidad de análisis una sentencia dictada por magistrados de primer nivel en un caso de hábeas corpus. La sentencia judicial escogida como objeto de estudio conformó la muestra. Para descomponer, analizar y esquematizar la estructura argumentativa de la sentencia se utilizó el método EL SER y el analítico-jurídico; además, como herramientas se emplearon cuestionarios para evaluar una motivación adecuada y suficiente y técnicas de análisis documental. Se llegó a la conclusión que, aunque la sentencia tiene una estructura argumentativa basada en leyes, posee criterios interpretativos discutibles en lo que concierne a proteger la libertad individual y presunción de inocencia.es_ES
dc.description.abstractAbstract:This research analyzes the sufficiency and adequacy of the reasoning provided in the judgment issued in Case No. 17113-2022-XXXXX, which concerned a *habeas corpus* action regarding the alleged expiration of the term for pre-trial detention in Ecuador. The study aimed to analyze and evaluate the judicial reasoning contained in the ruling to determine whether it met constitutional standards regarding due process and effective legal protection. The inquiry was conducted within the context of the Ecuadorian judicial system, using a judgment issued by first-instance magistrates in a *habeas corpus* case as the unit of analysis; this specific judgment constituted the study sample. To deconstruct, analyze, and outline the judgment's argumentative structure, the EL SER method and the analytical-legal method were employed; additionally, questionnaires designed to assess the adequacy and sufficiency of the reasoning, along with document analysis techniques, were used as tools. The study concluded that, although the judgment features an argumentative structure grounded in law, it relies on debatable interpretive criteria regarding the protection of individual liberty and the presumption of innocence.es_ES
