dc.descriptionResumen:El estudio de la vinculación del Derecho Penal con los ODS, se realizó mediante el acceso a información vinculada a la protección de derechos fundamentales, como el acceder a la Justicia. Así mismo el presente consistido en convenciones internacionales y legislaciones. El objetivo general de la investigación se refiere a determinar de qué manera las decisiones de los jueces han pretendido fortalecer el sistema de justicia penal en Ecuador y su aporte al ODS 16. A tal efecto, se analiza la sentencia N.° 053- 15-SEP-CC, Caso N.° 1127-12-EP, de la Corte Constitucional del Ecuador, del 4 de marzo de 2015. Esta sentencia resuelve una acción extraordinaria de protección planteada por los progenitores de una menor víctima de abuso sexual, por la denegación de notificación en la audiencia de casación por razón de tutela judicial efectiva, lo que acarrea la violación del debido proceso. La Corte Constitucional resolvió que existe vulneración de estos derechos y dispuso que realicen la audiencia con todas las debidas garantías procesales. Su estudio permite identificar prácticas del Derecho Penal con el fin de lograr justicia y en consecuencia, reparar a las víctimas, lo que evidencia la relación con el ODS 16: constructores de un sistema más justo, equitativo, ágil y eficiente de administración de justicia.es_ES
dc.description.abstractAbstract: The study regarding the link between criminal law and the SDGs was conducted by accessing information related to the protection of fundamental rights, such as access to justice. It also drew upon international conventions and legislation. The research aims to determine how judicial decisions have sought to strengthen the criminal justice system in Ecuador and contribute to SDG 16. To this end, the study analyzes Judgment No. 053-15-SEP-CC (Case No. 1127-12-EP), issued by the Constitutional Court of Ecuador on March 4, 2015. This ruling resolves an extraordinary action for constitutional protection filed by the parents of a minor who was a victim of sexual abuse; the action concerned the failure to provide notification for the cassation hearing a matter involving the right to effective judicial protection which resulted in a violation of due process. The Constitutional Court ruled that these rights had been violated and ordered that the hearing be held with all requisite procedural safeguards. This study identifies criminal law practices aimed at achieving justice and, consequently, providing reparation to victims, thereby highlighting the connection to SDG 16: the creation of a fairer, more equitable, agile, and efficient system of justice administration.es_ES
