dc.descriptionResumen:La investigación analiza la motivación en las sentencias dictadas por los jueces de primer nivel en Ecuador, a partir del estudio de un proceso ejecutivo de cobro de pagaré al orden tramitado ante la Unidad Judicial Civil de Santo Domingo. El propósito de este trabajo es comprobar si la sentencia seleccionada respeta los estándares de motivación suficiente y correcta previstos en la Constitución de la República, en la jurisprudencia de la Corte Constitucional y de doctrina sobre la fundamentación jurídica. Para abordar este objetivo opté por un enfoque cualitativo de tipo analítico; en concreto, utilicé el método de análisis de sentencias propuesto por Manuel Atienza, complementado con los criterios garantistas de Luigi Ferrajoli y con dos instrumentos elaborados para esta investigación: un cuestionario sobre estándar de suficiencia y el otro sobre motivación correcta. Los resultados muestran que, en el caso estudiado, la resolución judicial expone de forma clara y coherente las razones fácticas y normativas que sustentan la decisión, por lo que cumple con los estándares de motivación suficiente y correcta no procede su anulación por déficit de motivación.es_ES
dc.description.abstractAbstract: This research analyzes the reasoning provided in judgments issued by trial-level judges in Ecuador, based on a study of executive proceedings to collect on an order promissory note handled by the Civil Judicial Unit of Santo Domingo. The study aims to determine whether the selected judgment adheres to the standards of sufficient and correct reasoning established by the Constitution of the Republic, the case law of the Constitutional Court, and legal doctrine regarding the substantiation of judicial decisions. To address this objective, I adopted an analytical qualitative approach; specifically, I employed the judgment analysis method proposed by Manuel Atienza, complemented by Luigi Ferrajoli s due-process-oriented criteria and two instruments developed for this research: a questionnaire on the standard of sufficiency and another on correct reasoning. The results indicate that, in the case under study, the judicial decision clearly and coherently sets forth the factual and legal grounds supporting the ruling; consequently, it meets the standards for sufficient and correct reasoning, and there are no grounds for annulment due to a lack of adequate reasoning.es_ES
