Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The objective of this study is to analyze the reasoning behind the ruling issued by a first-instance judge in Ecuador specifically Judgment No. 09359-2019-XXXXX X, handed down by the Guayaquil Labor Judicial Unit regarding a constitutional protection action filed by thirty-two former employees of the Central Bank of Ecuador. The study employs a legal-analytical methodology focused specifically on the analysis of judicial reasoning. It utilizes legal document analysis, a standard-of-sufficiency-in-reasoning questionnaire, a correct-reasoning questionnaire, the SATJE system, and a review of legal doctrine and case law. The study concludes that the judgment meets the standard for sufficiency of reasoning; the judicial analysis complies with the mandate of Article 76, numeral 7, letter l) of the Constitution of the Republic of Ecuador; and the judgment s reasoning is sound regarding both normative and factual dimensions. Ultimately, the ruling resolves the workers' situation collectively through an expansive modulation based on principles of equality and distributive justice, demonstrating that constitutional justice possesses a collective and transformative scope.
