dc.descriptionResumen:La presente investigación, tiene su fundamento en analizar la improcedencia de la aplicación del delito de prevaricato en la labor garantista de los jueces constitucionales dentro de este Estado Constitucional de derechos y justicia. El estudio pretende demostrar que el juez constitucional se distingue del juez ordinario debido a que su actividad como administrador de justicia, se orienta a la protección efectiva de derechos fundamentales establecidos en la Norma Suprema, mediante la interpretación jurídica y la aplicación directa de la Constitución. Bajo estos parámetros, se logra examinar los fundamentos doctrinarios y normativos de la figura del prevaricato, así como analizar su naturaleza y demás elementos que aportan dentro del marco analítico. Se pretende también desarrollar un estudio de derecho comparado con la finalidad de contrastar lo dicho por las altas Cortes de los países vecinos como Colombia y Perú. Finalmente se establecerá un análisis jurisprudencial con lo propuesto por la Corte Constitucional del Ecuador, con el fin de determinar si la aplicación del delito de prevaricato resulta compatible con el ejercicio de la justicia constitucional.es_ES
dc.description.abstractAbstract: This research analyzes the impropriety of applying the crime of *prevaricato* (judicial misconduct/malfeasance) to the rights-safeguarding role of constitutional judges within this constitutional state based on rights and justice. The study aims to demonstrate that the constitutional judge differs from the ordinary judge because their activity as an administrator of justice is oriented toward the effective protection of fundamental rights enshrined in the Supreme Law, achieved through legal interpretation and the direct application of the Constitution. Within this framework, the research examines the doctrinal and normative foundations of the concept of *prevaricato*, while also analyzing its nature and other relevant elements. It also includes a comparative law study to contrast the positions held by the high courts of neighboring countries, such as Colombia and Peru. Finally, the study conducts a jurisprudential analysis of the Constitutional Court of Ecuador s position to determine whether applying the crime of *prevaricato* is compatible with the exercise of constitutional justice.es_ES
