dc.descriptionResumen:El presente trabajo analiza la motivación judicial en el reconocimiento de una relación laboral encubierta y el despido intempestivo en el trabajo doméstico, a partir de la sentencia del juicio N.º 10333-2023-03317, emitida por un juez de primer nivel en Ecuador. La investigación aplica el método analítico y la técnica EL SER, mediante la exploración, lectura, subrayado, esquematización y resumen de la sentencia, con apoyo en los cuestionarios de motivación suficiente y motivación correcta. El estudio permite identificar la estructura argumentativa del fallo, la relación entre hechos probados, normas aplicadas y decisión, así como la valoración de la prueba testimonial y documental. Los resultados evidencian que la sentencia cumple con el estándar de motivación suficiente, pues no presenta inexistencia, insuficiencia ni apariencia motivacional. Asimismo, se concluye que la motivación es correcta, ya que el juez selecciona normas pertinentes, las interpreta razonablemente y las aplica a los hechos acreditados. Se destaca la importancia de proteger derechos laborales en contextos de informalidad doméstico.es_ES
dc.description.abstractAbstract: This study analyzes the judicial reasoning regarding the recognition of a disguised employment relationship and abrupt dismissal in domestic work, based on the ruling in Case No. 10333-2023-03317, issued by a trial-level judge in Ecuador. The research employs the analytical method and the "EL SER" technique involving the exploration, reading, highlighting, outlining, and summarizing of the judgment supported by questionnaires assessing the sufficiency and correctness of the reasoning. The study identifies the ruling's argumentative structure and the relationship between established facts, applicable legal norms, and the decision, as well as the assessment of testimonial and documentary evidence. The results demonstrate that the judgment meets the standard for sufficient reasoning, as it exhibits neither a total lack of reasoning nor insufficiency or merely apparent reasoning. Furthermore, the reasoning is found to be correct, as the judge selects relevant legal norms, interprets them reasonably, and applies them to the established facts. The study highlights the importance of protecting labor rights within the context of informal domestic work.es_ES
