dc.descriptionResumen:La presente investigación analiza la motivación de una sentencia emitida por un juez de primer nivel en Ecuador, dentro del proceso civil ordinario Nro. 01333-2023-10799, relativo a la prescripción extraordinaria adquisitiva de dominio. El estudio parte de la importancia constitucional de la motivación como garantía del debido proceso, del derecho a la defensa y de la tutela judicial efectiva. Mediante el análisis de la argumentación judicial, se revisó la estructura de la sentencia, la narración de los hechos, el problema jurídico, las cuestiones normativas y fácticas, la ratio decidendi, la decisión y su coherencia con los fundamentos expuestos. Además, se aplicaron cuestionarios de motivación suficiente y motivación correcta. Como resultado, se determinó que la sentencia no carece totalmente de fundamentación; sin embargo, presenta insuficiencia normativa y fáctica, motivación aparente por incoherencia decisional e inatinencia jurídica parcial. El aporte del trabajo consiste en evidenciar la necesidad de fortalecer la calidad argumentativa de las decisiones judiciales de primer nivel.es_ES
dc.description.abstractAbstract: This research analyzes the reasoning behind a judgment issued by a trial-level judge in Ecuador within ordinary civil proceeding No. 01333-2023-10799, concerning the extraordinary acquisitive prescription of ownership. The study is grounded in the constitutional importance of judicial reasoning as a guarantee of due process, the right to a defense, and effective judicial protection. Through an analysis of the judicial argumentation, the study examined the judgment's structure, the narrative of facts, the legal issue, the normative and factual questions, the *ratio decidendi*, the decision itself, and its coherence with the stated grounds. Additionally, criteria regarding sufficient and correct reasoning were applied. The findings indicate that while the judgment is not entirely devoid of grounds, it suffers from normative and factual insufficiency, "apparent reasoning" due to decisional incoherence, and partial legal irrelevance. The study s contribution lies in highlighting the need to strengthen the quality of argumentation in trial-level judicial decisions.es_ES
