dc.descriptionResumen:La presente investigación analiza el alcance probatorio del Informe de Presunción Penal emitido por el Servicio de Rentas Internas en los casos de presunta defraudación tributaria por transacciones inexistentes. A partir del estudio de la normativa tributaria y penal, la jurisprudencia constitucional, la doctrina especializada y la práctica administrativa del Servicio de Rentas Internas, se examina la relación entre la presunción administrativa construida durante el procedimiento determinativo y el estándar probatorio exigido para acreditar la materialidad del delito en el proceso penal. El análisis evidencia que el Informe de Presunción Penal constituye un instrumento técnico legítimo para sustentar el inicio de la investigación penal; sin embargo, su naturaleza administrativa no le otorga eficacia probatoria suficiente para demostrar, por sí solo, la materialidad del delito, siendo indispensable una actividad probatoria autónoma desarrollada por la fiscalía general del Estado conforme a los principios del debido proceso y la presunción de inocencia. La investigación propone criterios jurídicos para delimitar el valor probatorio de dicho informe dentro del proceso penal ecuatoriano.es_ES
dc.description.abstractAbstract: This research analyzes the evidentiary scope of the Criminal Presumption Report issued by the Internal Revenue Service in cases of alleged tax fraud involving non-existent transactions. Based on a study of tax and criminal regulations, constitutional case law, specialized legal doctrine, and the administrative practice of the Internal Revenue Service, the study examines the relationship between the administrative presumption established during the tax assessment procedure and the evidentiary standard required to prove the material elements of the crime in criminal proceedings. The analysis demonstrates that the Criminal Presumption Report constitutes a legitimate technical instrument for justifying the initiation of a criminal investigation; however, its administrative nature does not grant it sufficient evidentiary weight to prove the material elements of the crime on its own. Consequently, independent evidentiary activity carried out by the State Attorney General's Office in accordance with the principles of due process and the presumption of innocence is essential. The research proposes legal criteria to define the evidentiary value of said report within the Ecuadorian criminal justice process.es_ES
