Abstract: Abstract: The general objective of this study was to analyze and evaluate the correctness and sufficiency of the reasoning provided in judgments issued by trial-level judges in Ecuador. Specific objectives included outlining the arguments within the selected trial-level judgment, analyzing the judgment's reasoning, and evaluating both the sufficiency and correctness of that reasoning using established standards. The underlying hypothesis posited that judgments issued by trial-level judges in Ecuador contain sufficient and correct reasoning. The study specifically examined case No. 061012017XXXXX, which involved a divorce suit based on Article 110 of the Civil Code; the grounds cited were abandonment of the marital home by the husband, with whom contact had been lost and whose whereabouts were unknown. The case was heard by the Judicial Unit for Family, Women, Children, and Adolescents of Riobamba Canton. The analysis of the judgment covered the presentation of arguments, the legal explanation provided, and an evaluation of the reasoning developed.
Description: Resumen:Este trabajo tuvo como objetivo general analizar y evaluar la motivación correcta y suficiente en las sentencias emitidas por los jueces de primer nivel en Ecuador. Los objetivos específicos se relacionaron con esquematizar las argumentaciones de la sentencia de primer nivel identificada, analizar la motivación de la sentencia, evaluar la motivación suficiente en la sentencia a través del cuestionario de estándar de suficiencia y, evaluar la motivación correcta a través del cuestionario de motivación correcta. La hipótesis subyacente planteó que las sentencias emitidas por los jueces de primer nivel en Ecuador cuentan con una motivación suficiente y correcta. De manera particular se hizo referencia al caso 061012017XXXXX sobre una demanda por divorcio sustentada en el artículo 110 del Código Civil, alegando el abandono del hogar por parte del conyugue masculino, con quien se pierde el contacto y se desconoce su paradero. La causa fue sustentada por la Unidad Judicial Familia, Mujer, Niñez y Adolescencia del Cantón Riobamba. El análisis de la sentencia consideró la presentación de argumentos, la explicación jurídica de la sentencia y el análisis de la argumentación desarrollada.
