dc.descriptionResumen:El presente trabajo de integración curricular evalúa la motivación en las sentencias emitidas por jueces de primer nivel en Ecuador. El objetivo general fue analizar y evaluar la motivación correcta y suficiente en las sentencias emitidas por los jueces de primer nivel en Ecuador. Se tomó la sentencia Nro. 01333-2022-XXXXX, de materia constitucional. Se aplicó el método analítico, cuestionarios estandarizados para evaluar la calidad del fallo, esto en base técnicas de esquematización argumentativa. En base a los descrito, se puede colegir que la sentencia cumple con el estándar mínimo constitucional de motivación suficiente, sin embargo, la profundidad jurídica y conexión lógica no son tan profundas, configurando una motivación inexacta, por tal motivo no llega al ideal de excelencia argumentativa. Se concluye que, aunque válida, la sentencia analizada se puede fortalecer en la argumentación jurídica, mediante un recurso procesal o recursos procesales que las partes podrían interponer con la finalidad de garantizar decisiones de calidad en el marco del Estado de Derechos, mismo que está consagrado en Constitución de la República del Ecuador.es_ES
dc.description.abstractAbstract: This curricular integration project evaluates the reasoning provided in judgments issued by trial-level judges in Ecuador. The general objective was to analyze and assess whether the reasoning in judgments issued by trial-level judges in Ecuador is correct and sufficient. Judgment No. 01333-2022-XXXXX, concerning a constitutional matter, was selected for analysis. An analytical method and standardized questionnaires were employed to evaluate the quality of the ruling, utilizing techniques for mapping the argumentation. Based on this analysis, it can be concluded that the judgment meets the minimum constitutional standard for sufficient reasoning; however, the legal depth and logical coherence are limited resulting in imprecise reasoning and thus it falls short of the ideal of argumentative excellence. It is concluded that, while valid, the judgment could be strengthened regarding its legal argumentation through procedural remedies filed by the parties, thereby ensuring high-quality decisions within the framework of the Rule of Law as enshrined in the Constitution of the Republic of Ecuador.es_ES
