dc.descriptionResumen:La presente tesis es el análisis de la motivación de una sentencia de acción de protección en el proceso 21282-2020-XXXXX permite evaluar la tutela de derechos en el entorno digital ecuatoriano. El presente trabajo de investigación resume como la sentencia manifestada por la Unidad Judicial de Lago Agrio incurrió en una motivación aparente e insuficiente, ya que denegó y rechazo una demanda de acción de protección por el bloqueo de un ciudadano en la página oficial de Facebook de una Alcaldía. El juez de primera instancia falló al no establecer una conexión coherente entre los hechos y el derecho, demandado cargas probatorias excesivas que ignoran la naturaleza de los espacios públicos digitales. El análisis de este trabajo consiste en identificar vicios como la inatinencia e incongruencia, evidenciando que la carencia de una fundamentación fáctica técnica vulnera el debido proceso y el derecho a la defensa. En conclusión, se establece que la sentencia judicial de primera instancia debe enmendarse a través de un recurso de apelación para evitar que la motivación judicial se convierta en un trámite con formalismo vacio, si.es_ES
dc.description.abstractAbstract:This thesis analyzes the reasoning behind a ruling on a *protección* action (a constitutional remedy for the protection of fundamental rights) in case No. 21282-2020-XXXXX, allowing for an evaluation of rights protection within the Ecuadorian digital landscape. The study outlines how the ruling issued by the Lago Agrio Judicial Unit relied on reasoning that was merely apparent and insufficient; the court denied and dismissed a claim regarding a citizen being blocked from a municipality's official Facebook page. The trial judge failed to establish a coherent link between the facts and the law, imposing excessive evidentiary burdens that disregarded the nature of digital public spaces. The analysis identifies flaws such as irrelevance and inconsistency, demonstrating that the lack of a technical factual basis violates due process and the right to a defense. In conclusion, the study determines that the trial court's ruling must be amended through an appeal to prevent judicial reasoning from becoming a mere exercise in empty formalism.es_ES
