dc.descriptionResumen:Esta investigación parte de un problema concreto en el cuál el padre o madre obligado deposita la pensión alimenticia en manos del representante legal del menor, el Estado da por cumplida su obligación y no existe ningún mecanismo que verifique si ese dinero realmente se destina a cubrir las necesidades del niño. El sistema apoyado en el Sistema Único de Pensiones Alimenticias (SUPA) funciona bien para fijar, recaudar y ejecutar el pago, pero se desentiende de lo que ocurre después, dejando un vacío normativo frente al principio del interés superior del niño. Para abordar esta problemática, se empleó un enfoque cualitativo, mediante una investigación jurídico-documental que analizó la Constitución, el Código de la Niñez y Adolescencia, doctrina especializada y jurisprudencia constitucional, con énfasis en la Sentencia No. 2158-17-EP/21. Los resultados confirman que, si bien el marco legal ecuatoriano es sólido para garantizar el pago, carece de herramientas para constatar su uso efectivo. A partir de esto, se plantea una propuesta de supervisión técnica excepcional a cargo de trabajo social y bajo orden judicial aplicable solo cuando existan indicios objetivos, sin comprometer la autonomía familiar.es_ES
dc.description.abstractAbstract: This research stems from a specific issue wherein the parent obligated to pay child support deposits the funds with the minor's legal representative; the State deems the obligation fulfilled without any mechanism to verify whether the money is actually used to meet the child's needs. While the system supported by the Unified Child Support System (SUPA) functions effectively regarding the setting, collection, and enforcement of payments, it disregards what happens subsequently, creating a regulatory gap concerning the principle of the best interests of the child. To address this issue, a qualitative approach was adopted through legal-documentary research analyzing the Constitution, the Code on Children and Adolescents, specialized legal doctrine, and constitutional jurisprudence with particular emphasis on Judgment No. 2158-17-EP/21. The findings confirm that, although the Ecuadorian legal framework is robust regarding payment guarantees, it lacks tools to verify the funds' actual use. Consequently, a proposal is put forward for exceptional technical oversight conducted by social workers under court order and applicable only when objective indications exist without compromising family autonomy.es_ES
