dc.descriptionResumen:La presente investigación analiza la garantía constitucional de la motivación en las sentencias de primer nivel en Ecuador, centrando su estudio en la Causa No. 17955-2014-XXXX, sobre fijación de pensión alimenticia. El objetivo primordial fue evaluar si efectivamente el razonamiento judicial cumple con los estándares de suficiencia y corrección establecidos por la Corte Constitucional. Para abordar este estudio, se optó por una metodología analítica apoyada en la técnica de esquematización propuesta por Atienza; y se complementó con la aplicación de cuestionarios diseñados para identificar posibles vicios en la motivación de las sentencias. Los resultados determinan que la resolución cuenta con una motivación valida. Logrando el juzgador articular el acuerdo conciliatorio con la normativa. Concluyendo que el magistrado coloco en primer lugar el Interés Superior del Niño, derivando en una decisión coherente y fácil de entender, garantizando la tutela judicial efectiva. Finalmente, se destaca que una motivación adecuada no solo previene la arbitrariedad, sino que fortalece la seguridad jurídica y la confianza ciudadana en la administración de justicia, consolidándose como un baluarte indispensable del debido proceso en el sistema legal ecuatorian.es_ES
dc.description.abstractAbstract: This research analyzes the constitutional guarantee regarding the reasoning of first-instance judgments in Ecuador, focusing on Case No. 17955-2014-XXXX, which concerned the determination of child support. The primary objective was to evaluate whether the judicial reasoning effectively met the standards of sufficiency and correctness established by the Constitutional Court. To conduct this study, an analytical methodology was adopted, utilizing the schematization technique proposed by Atienza; this was complemented by the use of questionnaires designed to identify potential flaws in the reasoning of the judgments. The results indicate that the ruling contains valid reasoning, as the judge successfully aligned the settlement agreement with the applicable legal regulations. It is concluded that the magistrate prioritized the Best Interests of the Child, resulting in a decision that is coherent and clear, thereby guaranteeing effective judicial protection. Finally, the study highlights that adequate reasoning not only prevents arbitrariness but also strengthens legal certainty and public trust in the administration of justice, serving as an indispensable pillar of due process within the Ecuadorian legal system.es_ES
