dc.descriptionResumen:La presente investigación analiza la aplicación de la muerte cruzada y su relación con la estabilidad democrática en el Ecuador. El estudio toma como punto de partida el artículo 148 de la Constitución de la República y la aplicación de este mecanismo mediante el Decreto Ejecutivo No. 741 de 17 de mayo de 2023. También examina la actuación de la Corte Constitucional frente a las demandas presentadas contra la disolución de la Asamblea Nacional y el control realizado sobre los decretos leyes de urgencia económica expedidos durante el periodo de transición. La investigación utiliza un enfoque cualitativo y se apoya en los métodos analítico como también descriptivo y explicativo. Para ello se revisaron normas constitucionales así como decisiones de la Corte Constitucional del Ecuador también jurisprudencia comparada y aportes doctrinarios relacionados con la separación de poderes y la estabilidad democrática. El estudio concluye que la muerte cruzada puede servir como una salida institucional frente a un conflicto grave entre el Ejecutivo y el Legislativo. Sin dejar de reconocer que la ausencia de un control material sobre la causal de grave crisis política y conmoción interna genera dudas sobre los límites de la decisión presidencial. La comparación con Perú y Colombia muestra que el control judicial y el control electoral pueden coexistir sin reemplazarse. Por lo que se considera necesario establecer parámetros más claros que permitan evitar el uso ordinario o estratégico de este mecanismo excepcional.es_ES
dc.description.abstractAbstract: This research analyzes the application of the "cross-death" mechanism (*muerte cruzada*) and its relationship with democratic stability in Ecuador. The study takes as its starting point Article 148 of the Constitution of the Republic and the application of this mechanism via Executive Decree No. 741 of May 17, 2023. It also examines the Constitutional Court's handling of challenges filed against the dissolution of the National Assembly and the review conducted regarding the decree-laws on urgent economic matters issued during the transition period. The research employs a qualitative approach, utilizing analytical, descriptive, and explanatory methods. To this end, the study reviewed constitutional provisions, decisions by the Constitutional Court of Ecuador, comparative jurisprudence, and scholarly contributions regarding the separation of powers and democratic stability. The study concludes that the "cross-death" mechanism can serve as an institutional solution to a serious conflict between the Executive and Legislative branches. However, it acknowledges that the lack of substantive review regarding the grounds of "serious political crisis and internal unrest" raises questions concerning the limits of the presidential decision. Comparisons with Peru and Colombia demonstrate that judicial oversight and electoral oversight can coexist without supplanting one another. Consequently, it is deemed necessary to establish clearer parameters to prevent the routine or strategic use of this exceptional mechanism.es_ES
