dc.descriptionResumen: La motivación judicial constituye una exposición del razonamiento fáctico y jurídico que permite verificar si un juez ha valorado de forma adecuada la prueba, de forma primordial el testimonio de la víctima. Esta investigación tuvo como objetivo principal analizar cómo los jueces ecuatorianos reconocen o ignoran las relaciones de poder y el ciclo de violencia, en casos de violencia intrafamiliar o de género, al aplicar el Código Orgánico Integral Penal (COIP). Se empleó una metodología cualitativa que incluyó revisión documental, análisis de sentencias y comparación de tipos penales y contravencionales. Los resultados evidencian que los jueces ecuatorianos, mayoritariamente consiguen una motivación firme que incorpora el reconocimiento de relaciones asimétricas entre víctima y agresor. Se concluye que una motivación judicial que integra el ciclo de violencia y las relaciones de poder fortalece la credibilidad del testimonio de la víctima y asegura decisiones penales y contravencionales con enfoque de género y derechos humanos, lo que contribuye a tener una justicia más efectiva en Ecuador.es_ES
dc.description.abstractAbstract: Judicial motivation constitutes an exposition of factual and legal reasoning that allows verifying whether a judge has adequately assessed the evidence, primarily the victim's testimony. The main objective of this research was to analyze how Ecuadorian judges either recognize or ignore power dynamics and the cycle of violence in cases of domestic or gender-based violence when applying the Organic Comprehensive Criminal Code (COIP). A qualitative methodology was employed, which included documentary review, analysis of court rulings, and comparison of criminal and contravention offenses. The results show that Ecuadorian judges mostly achieve firm motivation that incorporates the recognition of asymmetrical power dynamics between victim and aggressor. It is concluded that judicial motivation integrating the cycle of violence and power dynamics strengthens the credibility of the victim's testimony and ensures criminal and contravention decisions with a gender and human rights approach, thereby contributing to more effective justice in Ecuador.es_ES
