| dc.description | Resumen:El estudio analiza la motivación judicial de la sentencia emitida dentro del proceso No. 17233- 2023-06374, relacionado con la acción de protección presentada por Valeria Verónica Palmay Toro contra el Servicio Nacional de Derechos Intelectuales. La investigación examina si la decisión judicial articuló de forma adecuada los hechos, las normas aplicables y los precedentes constitucionales vinculados con la terminación de contratos ocasionales prolongados en el sector público. Se aplicó un diseño cualitativo, de tipo estudio de caso, con revisión documental, análisis jurídico-interpretativo y aplicación del método EL SER. Los resultados muestran que la sentencia reconoce la omisión argumentativa del SENADI al no justificar suficientemente la terminación contractual frente al tiempo de servicio de la accionante y al precedente constitucional sobre desnaturalización de contratos ocasionales. Se concluye que la motivación judicial cumple una función de control frente a decisiones administrativas que afectan derechos laborales y seguridad jurídica. | es_ES |
| dc.description.abstract | Abstract: This study analyzes the judicial reasoning behind the ruling issued in Case No. 17233-2023-06374, which concerned a protection action filed by Valeria Verónica Palmay Toro against the National Intellectual Property Service (SENADI). The research examines whether the judicial decision adequately addressed the facts, applicable legal provisions, and constitutional precedents regarding the termination of long-term "occasional" (temporary) contracts in the public sector. A qualitative case-study design was employed, utilizing document review, legal-interpretative analysis, and the EL SER method. The results indicate that the ruling acknowledges SENADI s failure to provide sufficient argumentation to justify the contract termination, particularly in light of the plaintiff's length of service and constitutional precedents concerning the reclassification of occasional contracts. The study concludes that judicial reasoning serves a supervisory function regarding administrative decisions that impact labor rights and legal certainty. | es_ES |
