| Abstract: | Abstract: This research study examines and analyzes a ruling issued by a court of first instance in case No. 17282-2024-XXXXX, which addresses the legal status of an individual prosecuted for the crime of extortion an offense defined in Article 185 of the Comprehensive Organic Penal Code. The study evaluates whether the ruling adheres to due process by correctly applying the guarantee of reasoned decision-making, as stipulated in Article 76, numeral 7, letter l of the Constitution of the Republic. To identify potential deficiencies in the reasoning provided, the study applies Constitutional Court jurisprudence specifically ruling No. 1158-17-EP/21 using the "reasoning test" to determine the presence of any flaws or defects in the justification of the decision. |
| Description: | Resumen:En el presente trabajo de investigación se estudia y analiza la resolución emitida por un juez de primera instancia dentro del proceso No. 17282-2024-XXXXX donde se resuelve sobre la situación jurídica de una persona procesada por el delito de extorsión tipificado en el artículo 185 del Código Orgánico Integral Penal. Se evalúa si dicha sentencia cumple con el debido proceso al ser aplicado correctamente la garantía de motivación conforme el articulo 76 numeral 7 literal l de la Constitución de la República, para determinar posibles deficiencias motivacionales dentro de dicho proceso se aplicó jurisprudencia de la Corte Constitucional, en específico la sentencia No. 1158-17-EP/21 para en base al test de motivación determinar si existen o no deficiencias o vicios motivacionales. |
