| dc.description | Resumen:Este trabajo realiza un análisis exhaustivo sobre la motivación en las sentencias judiciales de primer nivel en Ecuador, enfocándose en la suficiencia y corrección de fundamentación en materia laboral. Se destaca que la motivación es un pilar esencial para garantizar la transparencia, legitimidad y justicia en el sistema judicial, así como para prevenir arbitrariedades y proteger los derechos procesales. La investigación analiza doctrinas, jurisprudencia y casos concretos para establecer estándares claros de motivación suficiente y correcta. Además, se evalúa una sentencia específica según parámetros metodológicos que incluyen la representación, análisis y esquematización de argumentos jurídicos. Los resultados evidencian que una adecuada motivación fortalece la seguridad jurídica, la confianza en la administración de justicia y el derecho a la defensa. El trabajo subraya la necesidad de promover una mayor formación judicial y mecanismos de control más efectivos para mejorar la calidad de las decisiones en materia laboral, contribuyendo así a un sistema judicial más justo, transparente y confiable. | es_ES |
| dc.description.abstract | Abstract: This study conducts a comprehensive analysis of the reasoning provided in first-instance judicial rulings in Ecuador, focusing on the adequacy and correctness of the legal grounds in labor law cases. It highlights that judicial reasoning is a fundamental pillar for ensuring transparency, legitimacy, and justice within the judicial system, as well as for preventing arbitrary actions and protecting procedural rights. The research examines legal doctrine, case law, and specific cases to establish clear standards for adequate and correct reasoning. Furthermore, a specific ruling is evaluated based on methodological parameters that include the representation, analysis, and structuring of legal arguments. The results demonstrate that proper reasoning strengthens legal certainty, public confidence in the administration of justice, and the right to a defense. The study underscores the need to promote enhanced judicial training and more effective oversight mechanisms to improve the quality of labor law decisions, thereby contributing to a fairer, more transparent, and more reliable judicial system. | es_ES |
