dc.descriptionResumen:El presente trabajo analiza la motivación de la sentencia No. 11258-2023-XXXXX, la cual fue emitida el 24 de noviembre del año 2023 misma que fue emitida por el Tribunal Segundo de Garantías Penales de Loja. El caso trata de un hecho de sicariato ocurrido en el cantón Catamayo, en el cual se concluyó que el señor D.J actuó como ejecutor material del ataque. Acto por el cual el señor A.V perdió la vida, mientras que J. A participo en la planificación y financiamiento de dicho hecho, por el cual ofreció una recompensa económica. El análisis se desarrolla desde la metodología de argumentación jurídica desarrollada por Manuel Atienza y los estándares de suficiencia motivacional desarrollados por la Corte Constitucional del Ecuador. A partir de la evaluación de los fundamentos normativos y probatorios, este estudio concluye que la decisión judicial cumple con los estándares constitucionales de motivación. Sin embargo, se identifican ciertos puntos de menor desarrollo argumentativo que podrían mejorarse pero que no afectan la validez jurídica.es_ES
dc.description.abstractAbstract: This study analyzes the reasoning behind Judgment No. 11258-2023-XXXXX, issued on November 24, 2023, by the Second Criminal Guarantees Court of Loja. The case concerns a contract killing in the Catamayo canton, in which it was determined that Mr. D.J. was the actual perpetrator of the attack an act that claimed the life of Mr. A.V. while Mr. J.A. participated in planning and financing the crime, offering a monetary reward for it. The analysis employs the legal argumentation methodology developed by Manuel Atienza and the standards for sufficiency of reasoning established by the Constitutional Court of Ecuador. Based on an evaluation of the legal and evidentiary grounds, this study concludes that the judicial decision meets constitutional standards regarding the reasoning of judgments. However, certain areas with less developed argumentation are identified; while these could be improved, they do not affect the decision's legal validity.es_ES
