dc.descriptionResumen:La presente investigación analiza la calidad de la motivación en las sentencias de primer nivel en Ecuador, tomando como caso de estudio el proceso penal Nro. 11282-2024-XXXXX por tráfico ilícito de sustancias. El objetivo central es evaluar si el razonamiento judicial cumple con los estándares de lógica, suficiencia y comprensibilidad exigidos por la Constitución y la Corte Constitucional, especialmente en decisiones que restringen derechos fundamentales. El estudio se enfoca en la negativa de la suspensión condicional de la pena, analizando cómo el juzgador justifica el incumplimiento de los requisitos legales, particularmente la reincidencia del procesado. Mediante una metodología cualitativa y el uso de un método analítico, se examina si la existencia de antecedentes penales fue debidamente motivada como factor determinante para negar el beneficio penitenciario. Los hallazgos pretenden demostrar que la transparencia en la determinación de la reincidencia es esencial para evitar la arbitrariedad, garantizando que la sanción penal sea el resultado de un análisis jurídico riguroso y no de una aplicación automática de la norma.es_ES
dc.description.abstractAbstract: This research analyzes the quality of the reasoning provided in first-instance judgments in Ecuador, using criminal case No. 11282-2024-XXXXX involving the illicit trafficking of substances as a case study. The primary objective is to evaluate whether the judicial reasoning meets the standards of logic, sufficiency, and clarity required by the Constitution and the Constitutional Court, particularly in decisions that restrict fundamental rights. The study focuses on the denial of the conditional suspension of the sentence, analyzing how the judge justifies the failure to meet legal requirements, specifically the defendant's status as a repeat offender. Employing a qualitative approach and an analytical method, the study examines whether the existence of a prior criminal record was duly substantiated as a decisive factor in denying this sentencing benefit. The findings aim to demonstrate that transparency in establishing repeat-offender status is essential to avoid arbitrariness, ensuring that the criminal sanction results from rigorous legal analysis rather than the automatic application of the law.es_ES
