dc.descriptionResumen:Este proyecto de investigación estudia la garantía constitucional de la motivación en el Ecuador, analizando si las sentencias de primer nivel cumplen con los lineamientos vigentes de suficiencia fáctica y normativa. Con una visión cualitativa, se utilizó el método analítico de Análisis de la Motivación de Sentencias y la estrategia metodológica "EL SER" en la sentencia de divorcio por causal del proceso Nro. 17205-2017-00881, emitida en el cantón Rumiñahui. Los resultados, obtenidos a través de cuestionarios técnicos con base en la jurisprudencia hito No. 1158-17-EP/21 de la Corte Constitucional, evidenciaron que la sentencia posee una estructura argumentativa completa y correcta, eliminando vicios como la inexistencia, insuficiencia o apariencia de motivación. Sin embargo, el análisis del caso muestra una marcada tensión entre el régimen sustantivo civil ecuatoriano anacrónico y punitivo contra principios constitucionales de dignidad humana y libre desarrollo de la personalidad. Se concluye que el fallo judicial es válido y legítimo, y se recomienda impulsar reformas legislativas para el divorcio incausado o de sola voluntad, para armonizar la norma con la realidad social.es_ES
dc.description.abstractAbstract: This research project examines the constitutional guarantee regarding the requirement for judicial reasoning in Ecuador, analyzing whether first-instance judgments comply with current guidelines on factual and legal sufficiency. Adopting a qualitative approach, the study employed the analytical method of "Judgment Reasoning Analysis" and the "EL SER" methodological strategy to evaluate the fault-based divorce judgment in case No. 17205-2017-00881, issued in the Rumiñahui canton. The results obtained via technical questionnaires based on the Constitutional Court s landmark ruling No. 1158-17-EP/21 demonstrated that the judgment possesses a complete and correct argumentative structure, free from defects such as the absence, insufficiency, or mere appearance of reasoning. However, the case analysis reveals a marked tension between the Ecuadorian substantive civil law regime characterized as anachronistic and punitive and constitutional principles regarding human dignity and the free development of personality. The study concludes that the judicial ruling is valid and legitimate, and recommends promoting legislative reforms to introduce no-fault or unilateral divorce, thereby aligning the legal framework with social reality.es_ES
