Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research analyzes the requirement for correct and sufficient reasoning in judgments issued by trial-level judges in Ecuador, using Judgment No. 05283-2020-01453 from the Latacunga Criminal Judicial Unit as a case study. The objective was to evaluate whether the ruling complies with constitutional, doctrinal, and jurisprudential standards regarding judicial reasoning. An analytical method was employed, involving a structural breakdown of the judgment, an examination of its arguments, and the application of the sufficiency standard and a "correct reasoning" checklist. The results demonstrated that the judgment presents clear, coherent, relevant, and sufficient reasoning, thereby guaranteeing due process, effective judicial protection, and legal certainty. It is concluded that adequate judicial reasoning strengthens the legitimacy of jurisdictional decisions and constitutes an essential guarantee within a constitutional state based on rights and justice.
