dc.descriptionResumen:El presente escrito aborda la motivación del fallo dictado en el ámbito del proceso Nro. 17203- 2024-01761, proceso de fijación de pensión alimenticia resuelto por una magistrada en primera instancia del ámbito de Familia, Mujer, Niñez y Adolescencia; el trabajo examina si la decisión de la jueza fue adecuada respecto de la motivación, desde la localización del problema jurídico, cuestiones normativas y fácticas, la respuestas, ratio decidendi, obiter dicta, solución y la propia decisión judicial. Se utilizó una metodología analítica, documental y jurídica, apoyada en la técnica de representación de argumentos de Atienza y en los criterios desarrollados por la Corte Constitucional del Ecuador. Los resultados concluyen que la sentencia no es del todo carente de motivación, ni tiene apariencia motivacional pero sí suficiente en la explicación del cálculo de la pensión alimentaria alimenticia; explicaciones que son insuficientes en lo que hace a la aplicación de la tabla alimentaria y a la valoración fáctica del monto determinado.es_ES
dc.description.abstractAbstract: This paper addresses the reasoning behind the ruling issued in case No. 17203-2024-01761 a child support determination case resolved by a judge of first instance specializing in Family, Women, Children, and Adolescents law. The study examines the adequacy of the judge's reasoning, covering the identification of the legal issue, normative and factual questions, the responses provided, the *ratio decidendi*, *obiter dicta*, the resolution, and the judicial decision itself. An analytical, documentary, and legal methodology was employed, drawing upon Atienza s argument representation technique and criteria established by the Constitutional Court of Ecuador. The findings conclude that the judgment is not entirely devoid of reasoning, nor does it merely offer a superficial appearance of reasoning; rather, it provides a sufficient explanation regarding the calculation of the support amount though these explanations prove insufficient concerning the application of the support scale and the factual assessment of the determined sum.es_ES
