dc.descriptionResumen:El presente estudio se basó en el proceso No.19304-2019-XXXXX correspondiente a una acción de protección por la intervención en áreas de bosque y vegetación protectora de la Cuenca Alta del Río Nangaritza que ha sido vulnerada por el Estado ecuatoriano. El trabajo analiza la garantía de motivación a través de sentencias de primera instancia en Ecuador, pues se evalúa la decisión de los jueces para determinar los estándares de suficiencia y motivación correcta exigidos por la Corte Constitucional a través de la sentencia No.1158-17- EP/21, se aplicó la esquematización de Manuel Atienza y el cuestionario de motivación, donde evalúa la existencia de vicios como la inexistencia, insuficiencia o apariencia. El resultado demuestra que, aunque el fallo satisfaga el estándar de motivación fue revocado en apelación bajo una perspectiva formalista, ya que en primera instancia se probó la omisión por parte del Ministerio del Ambiente, el Ministerio de Recursos no Renovables y la Agencia de Regulación y Control Minero (ARCOM), este trabajo aporta elementos para mejorar la calidad de argumentación y sobre la seguridad jurídica de las garantías jurisdiccionales de primera instancia.es_ES
dc.description.abstractAbstract: This study was based on Case No. 19304-2019-XXXXX, which involved a constitutional protection action regarding State-sanctioned encroachment upon forest and protective vegetation areas in the Upper Nangaritza River Basin. The study analyzes the requirement for reasoned judicial decisions specifically examining first-instance rulings in Ecuador to determine whether the judges' decisions met the standards of sufficiency and proper reasoning mandated by the Constitutional Court in Judgment No. 1158-17-EP/21. Manuel Atienza s analytical framework and a reasoning assessment questionnaire were applied to evaluate the presence of defects such as the absence, insufficiency, or merely apparent nature of the reasoning. The results show that, although the initial ruling met the standard for reasoning, it was overturned on appeal based on a formalistic approach despite the fact that the first-instance court had established the omission of duties by the Ministry of the Environment, the Ministry of Non-Renewable Natural Resources, and the Mining Regulation and Control Agency (ARCOM). This study contributes insights for improving the quality of legal argumentation and enhancing legal certainty regarding first-instance judicial protection proceedings.es_ES
