| Abstract: | Abstract:This research analyzes from legal-tax and documentary perspectives the challenges that transactions involving fungible crypto-assets and the risks of layering pose to income tax oversight in Ecuador. Although the Central Bank of Ecuador has clarified that crypto-assets do not constitute legal tender or an authorized means of payment, these transactions can generate income, capital gains, exchanges, or increases in net worth with tax implications. The study examines the applicable constitutional, legal, and institutional framework; identifies layering risks affecting tax traceability, income attribution, valuation, documentation, and evidence; and determines the limitations faced by the Tax Administration regarding audits and tax assessments. Based on this analysis, the study proposes improvements regarding documentation, valuation, third-party reporting, institutional cooperation, and the gathering of evidence, drawing on standards from the FATF, GAFILAT, and the OECD s Crypto-Asset Reporting Framework (CARF) |
| Description: | Resumen:La presente investigación analiza, desde una perspectiva jurídico-tributaria y documental, los desafíos que las operaciones con cripto activos fungibles y los riesgos de estratificación plantean al control del Impuesto a la Renta en Ecuador. Aunque el Banco Central del Ecuador ha precisado que los cripto activos no constituyen moneda de curso legal ni medio de pago autorizado, estas operaciones pueden generar rentas, ganancias, permutas o incrementos patrimoniales con incidencia fiscal. El estudio examina el marco constitucional, legal e institucional aplicable; identifica los riesgos de estratificación que afectan la trazabilidad fiscal, la atribución de rentas, la valoración, el soporte documental y la prueba; y determina las limitaciones que enfrenta la Administración Tributaria en la fiscalización y determinación. Sobre esa base, se proponen criterios de mejora en materia de documentación, valoración, reportes de terceros, cooperación institucional y construcción de prueba, con referencia a los estándares del GAFI/FATF, GAFILAT y el Marco de Comunicación de Información sobre Cripto activos (CARF) de la OCDE. |
