| Abstract: | Abstract:This study analyzes the development of the guarantee regarding the requirement to provide reasons for decisions (*motivación*) within Ecuadorian constitutional jurisprudence, examining its constitutional, doctrinal, and jurisprudential foundations within the framework of due process. It examines the evolution of criteria established by the Constitutional Court of Ecuador concerning this guarantee and outlines the current applicable standards. To achieve this, a qualitative legal approach was employed, supported by a documentary review of the Constitution, specialized legal doctrine, and rulings issued by the Constitutional Court. The analysis reveals that the interpretation of this guarantee has evolved from a model based on criteria of reasonableness, logic, and clarity toward a standard based on the sufficiency of the reasoning provided, as established in Judgment No. 1158-17-EP/21. The study concludes that the requirement to provide reasons is an indispensable guarantee for protecting due process, effective judicial protection, and legal certainty; it mandates that decisions by public authorities be duly substantiated, thereby strengthening the legitimacy of state action and providing a safeguard against potential arbitrary conduct. |
| Description: | Resumen:La presente analiza el desarrollo de la garantía de la motivación en la jurisprudencia constitucional ecuatoriana, a partir del estudio de su fundamento constitucional, doctrinario y jurisprudencial dentro del marco del debido proceso. El presente analizó la evolución de los criterios desarrollados por la Corte Constitucional del Ecuador en torno a la garantía de la motivación, también elaboró una línea jurisprudencial que identifica los estándares aplicables actuales. Para alcanzar esto, se utilizó un enfoque cualitativo de carácter jurídico, apoyado en la revisión documental de la Constitución, doctrina especializada y sentencias emitidas por la Corte Constitucional. El análisis evidenció que la interpretación de esta garantía ha evolucionado desde un modelo sustentado en criterios de razonabilidad, lógica y comprensibilidad hacia un estándar basado en suficiencias motivacionales, establecidos por la Sentencia No. 1158-17-EP/21. Concluye que la motivación constituye una garantía indispensable para la protección del debido proceso, la tutela judicial efectiva y la seguridad jurídica, ya que exige que las decisiones de las autoridades públicas encuentren debidamente fundamentadas, fortaleciendo así la legitimidad de la actuación estatal y el control frente a posibles arbitrariedades. |
