| Abstract: | Abstract: This thesis provides a critical analysis of the issues arising from the lack of adequate reasoning in judicial decisions issued by courts of first instance in Ecuador. Specifically, it examines judgment No. 03204-2024-xxxxx, which concerns a negligent traffic offense resulting in permanent disability for the victim caused by negligence, lack of skill, abandonment, and a breach of the objective duty of care required when driving. These actions are penalized under Article 379 and Article 152 (Section 5) of the Comprehensive Organic Criminal Code. The analysis confirms that the ruling issued by the judge meets the standards for sufficient reasoning; no flaws in reasoning such as irrelevance, inconsistency, incomprehensibility, or incoherence were found. This demonstrates that the judge s decision rests on a solid factual and legal foundation to establish liability, as the defendant's unlawful conduct constituted a negligent traffic offense. Consequently, the court imposed a 45-month prison sentence, a fine, the loss of citizenship rights, a requirement for full reparation to the victim, and a lifetime pension equivalent to the Unified Basic Wage for general workers. |
| Description: | Resumen:En el presente trabajo de titulación nos permite obtener un análisis crítico a los problemas derivados por la falta de motivación a las decisiones judiciales emitidas por jueces de primera instancia en el Ecuador. En esta oportunidad se analiza la sentencia 03204-2024-xxxxx, por un delito culposo de tránsito con consecuencia de incapacidad permanente de la víctima, causado por la negligencia, impericia, abandono y por haber violado el deber objetivo de cuidado que debe observarse al momento de conducir un vehículo, sancionados en el artículo 379 y 152 numeral 5 del Código Orgánico Integral Penal. Hemos podido comprobar que el fallo emitido por el señor juez cumple con los estándares de motivación suficientes, así como también no se ha evidenciado vicios motivacionales como son: inatinencia, incongruencia, incomprensibilidad e incoherencia, esto nos demuestra que la decisión adoptada por el señor juez cuenta con una fundamentación fáctica y jurídica suficiente para declarar responsable por adecuar su conducta antijurídica al delito culposo de tránsito, por lo que se le impone una pena privativa de libertad de 45 meses, multa, pérdida de los derechos de ciudadanía, la reparación integral a la víctima y una pensión vitalicia de un salario básico unificado del trabajador en general. |
