Abstract: Abstract: This study analyzes the jurisprudential development of the principle of favorability in Ecuador, based on criteria systematized by the Constitutional Court. The article begins by noting that, despite the express recognition of this principle in Article 76, numeral 5 of the Constitution, its practical application involves divergent criteria that generate legal uncertainty. Using a qualitative approach specifically a legal-dogmatic and jurisprudential analysis the study examined rulings issued by the Constitutional Court of Ecuador between 2020 and 2025 to systematize the applied criteria and explain the consequences of interpretive variability. The results demonstrate that the principle of favorability is not limited to a quantitative comparison of penalties but extends to procedural and enforcement aspects; furthermore, its most frequent violation stems not from erroneous interpretation, but from the adjudicator's failure to rule on the argument raised. Additionally, it was found that this principle can be invoked *ex officio*, even when the petitioner's primary claim does not succeed. The study concludes that bridging the gap between the formal recognition and the effective application of the principle of favorability represents a key contribution to strengthening due process in criminal proceedings in Ecuador.
Description: Resumen:El presente trabajo analiza el desarrollo jurisprudencial del principio de favorabilidad en el Ecuador, a partir de los criterios sistematizados por la Corte Constitucional, el presente artículo parte de constatar que, pese al reconocimiento expreso de este principio en el artículo 76 numeral 5 de la Constitución, su aplicación práctica presenta criterios divergentes que generan inseguridad jurídica, bajo un enfoque cualitativo, de carácter jurídico-dogmático y jurisprudencial, se analizaron sentencias emitidas por la Corte Constitucional del Ecuador entre 2020 y 2025, con el propósito de sistematizar los criterios aplicados y explicar las consecuencias de la variabilidad interpretativa. Por ello, los resultados evidencian que la favorabilidad no se limita a la comparación cuantitativa entre penas, sino que se extiende a los aspectos procesales y de ejecución, y que su vulneración más frecuente no radica en una interpretación errónea, sino en la omisión del juzgador al no pronunciarse sobre el alegato planteado. Asimismo, se constató que este principio puede activarse de oficio, incluso cuando el cargo principal del accionante no prospera. Se concluye que superar la brecha entre el reconocimiento formal y la aplicación efectiva del principio de favorabilidad constituye un aporte central para el fortalecimiento del debido proceso penal en el Ecuador.
