| Abstract: | Abstract: This study aims to analyze the reasoning provided in judgments issued by judges of first instance in Ecuador. To achieve this objective, a civil judgment concerning the extraordinary acquisitive prescription of ownership of a property located in Pastaza province was analyzed. The research employed analytical methods and the "EL SER" approach to break down the judgment into its normative and factual elements, with the aim of evaluating compliance with the standard of sufficient and correct reasoning. The results indicated that the analyzed judgment meets the minimum standard of reasoning required by the Constitution. It was found that, while the decision in the analyzed judgment meets the minimum standard of reasoning, it falls short of the level of "correct reasoning" which demands high-quality argumentation thereby highlighting the need to strengthen legal argumentation in judicial decisions to improve the quality of reasoning. |
| Description: | Resumen:El presente trabajo tiene como objeto el analizar la motivación en las sentencias emitidas por jueces de primera instancia en Ecuador. A fin de cumplir con el objetivo propuesto, para lo cual se procedió a realizar el análisis de una sentencia en materia civil que trata la prescripción adquisitiva extraordinaria de dominio de un predio ubicado en la provincia de Pastaza. La investigación se desarrolló mediante el empleo de los métodos analíticos y EL SER , que descomponen la sentencia en sus elementos normativos y fácticos, el fin de esta investigación es evaluar el cumplimiento del estándar de motivación suficiente y correcta. Como resultado, se determinó que la sentencia analizada cumple con el estándar mínimo de motivación exigido por la Constitución. Se evidenció que la decisión tomada en la sentencia analizada cumple con el estándar mínimo de motivación pero no alcanza el nivel de motivación correcta que requiere de una alta calidad argumentativa, lo que plantea la necesidad de reforzar la argumentación jurídica en decisiones judiciales a fin de mejorar la calidad de motiva. |
