Abstract: Abstract: This thesis analyzes the reasoning behind the judgment issued by the Riobamba Criminal Guarantees Tribunal in case No. 06282-2024-02839, concerning the alleged crime of fraud as defined in Article 186 of the Comprehensive Organic Penal Code. The general objective is to analyze and evaluate whether the judgment s reasoning is correct and sufficient, determining whether it meets the constitutional and doctrinal standards required in a constitutional state based on rights and justice. The research employed a qualitative, documentary-based approach, utilizing the analytical legal method, Atienza s "EL SER" method, and standard questionnaires regarding sufficiency and correctness of reasoning as evaluation tools. The study focused on the judgment handed down on October 14, 2025, in which the Tribunal upheld the innocence of the accused following the Prosecutor's Office's decision not to press charges, basing its ruling on the accusatorial principle enshrined in Article 609 of the Comprehensive Organic Penal Code. The results indicate that, while the judgment s reasoning is procedurally sufficient regarding its formal structure, it is substantively insufficient, as it fails to provide an in-depth analysis of the constituent elements of the crime of fraud. The study concludes that the judicial decision is valid from the perspective of the accusatorial system but could be improved regarding the depth of the legal reasoning applied.
Description: Resumen:El presente trabajo de titulación analiza la motivación de la sentencia emitida por el Tribunal de Garantías Penales de Riobamba dentro del proceso N.º 06282-2024-02839, seguido por el presunto delito de estafa tipificado en el artículo 186 del Código Orgánico Integral Penal. El objetivo general consiste en analizar y evaluar la motivación de forma correcta y suficiente de dicha sentencia, determinando si cumple con los debidos estándares constitucionales y doctrinarios que se exige en el Estado constitucional de derechos y justicia. La investigación se desarrolló aplicando un enfoque cualitativo de tipo documental, aplicando el método jurídico analítico, el método EL SER propuesto por Atienza y los cuestionarios estándares de suficiencia y motivación correcta como técnicas de evaluación. El estudio se realizó sobre la sentencia dictada el 14 de octubre del 2025, en donde el Tribunal ratifico la inocencia de los procesados ante la abstención de acusación por parte de la Fiscalía, fundamentándose en el principio acusatorio recogido en el artículo 609 del Código Orgánico Integral Penal. Los resultados también evidencian que la sentencia presenta una motivación de carácter procesal suficiente en lo que respecta a su estructura formal; sin embargo, adolece de insuficiencia táctica, al no desarrollar un análisis de fondo sobre los elementos constitutivos del delito de estafa. Se concluye que la decisión judicial es válida vista desde la perspectiva del sistema acusatorio, pero es susceptible de mejora de acuerdo con la profundidad del razonamiento jurídico aplicado.
