Abstract: This judgment analysis focuses on the distortion of judicial safeguards specifically where illegitimate decisions were issued as precautionary measures during criminal proceedings for money laundering. It examines the *acción de protección* (constitutional protection action) and its enforcement at both first and second instances, alongside various legal issues: the handling of the action at both levels (which led to the distortion of constitutional guarantees by leaving the case without a precautionary measure); the jurisdiction to set aside a declaration of tacit withdrawal; and the authority to extend the scope of the ruling regarding the violation of rights found in the second-instance decision. Furthermore, regarding the petitioners and their defense counsel, the analysis considers whether there was an abuse of the right to litigate and addresses the recognition of this distortion caused by the inexcusable misconduct of certain judges which resulted in investigations and sanctions for the criminal offense of malfeasance (*prevaricato*)es_ES
