Abstract: Abstract:This research aimed to analyze the application of executive proceedings in the collection of obligations contained in enforceable instruments through the study of Case No. 09332-2020-05302, in order to determine compliance with legal requirements and the sufficiency of judicial reasoning in the event of non-compliance with a credit obligation. An analytical and legal-documentary approach was applied through the review of the case file and content analysis. The results showed that the promissory note met the requirements to constitute an enforceable instrument, that the defendants were in default and did not file an opposition within the legal term, and that the judicial authority verified the existence of a clear, determined, and enforceable obligation. The judgment of August 23, 2021, upheld the claim and ordered payment of the principal, interest, and accessory obligations. It was concluded that executive proceedings are an effective mechanism for credit protection and that the judgment analyzed contains sufficient legal reasoning to understand the grounds for the decision, thereby guaranteeing due process and legal certainty.
