| Abstract: | Abstract: This research analyzes the conditional suspension of a sentence as an alternative to deprivation of liberty for convicted individuals with no prior criminal record within the Ecuadorian legal system. Employing a qualitative and doctrinal-legal design, the study examined legal theory, regulations, and case law related to the purposes of sentencing, the principle of minimum penal intervention, proportionality, and social rehabilitation. It also examined the provisions of the Comprehensive Organic Penal Code, the 2023 reform, and Judgment 50-21-CN/22 (and its consolidated cases), focusing on their application within abbreviated proceedings. The analysis demonstrates that this mechanism allows for the suspension of a sentence's execution subject to judicial conditions without negating criminal liability and can prevent the consequences associated with incarceration when statutory requirements are met. The study argues that applying this measure to individuals without a criminal record requires consideration of the specific circumstances of the case, social reintegration, and constitutional limits on punitive power. |
