| Abstract: | Abstract:This study analyzes the reasoning behind a criminal judgment for the crime of robbery with violence, aiming to verify whether it meets the requirements established by the Constitution and the jurisprudence of the Constitutional Court of Ecuador. To this end, the study examined the legal grounds and the assessment of evidence presented during the trial, including testimonies, expert reports, and other elements incorporated into the proceedings. Furthermore, it examined how the court justified the criminal liability of the accused and the relationship between the proven facts and the decision reached. The analysis determined that the judgment contains sufficient reasoning, as it sets forth the factual and legal grounds supporting the conviction. However, it also identified that certain doctrinal aspects could have been developed in greater depth. This study highlights the importance of judicial reasoning as a guarantee of due process and legal certainty within the administration of justice. |
