| Abstract: | Abstract: This thesis focuses on SDG 16 (Sustainable Development Goal 16), which aims to promote just, peaceful, and inclusive societies and to build effective and transparent institutions. This goal addresses key issues such as access to justice, the reduction of violence, and the promotion of the rule of law. However, in practice, the fundamental legal principle of due process is often violated. When determining a penalty, it must be understood that due process entails guaranteeing justice and fairness within the legal proceedings. Violations of due process can lead to arbitrary judicial decisions. The role of the lawyer is crucial in situations where due process has been violated. Lawyers play a vital role in representing clients and ensuring their legal rights are upheld; they also play an important part in educating the public about the importance of a fair trial and in advocating for legal reforms that strengthen the protection of these fundamental rights. This includes providing legal counsel, properly presenting evidence and arguments, and advocating for justice and fairness within the legal system. Ultimately, the involvement of lawyers is essential to safeguarding the integrity of the judicial system and ensuring that SDG 16 fosters a society where justice is guaranteed and individual rights are respected. |
