| Abstract: | Abstract:This curricular integration project aims to analyze the reasoning behind first-instance judgments in Ecuador as an essential element of due process and effective judicial protection. The analysis focuses on verifying whether judicial rulings meet the constitutional and legal requirements for their issuance, particularly regarding the relationship between the facts of the case, the assessment of evidence, and the application of legal norms. To this end, a labor law judgment was selected, revealing a certain degree of lack of clarity; while this does not affect the substance of the decision, it compromises its quality. An analysis was also conducted regarding the "correct and sufficient reasoning" test established by the Constitutional Court of Ecuador, as well as the specific subject matter of the judgment a claim for compensation for abrupt dismissal. The results demonstrate that incorrect or insufficient reasoning infringes upon individuals' rights and weakens the judicial system, highlighting the need to strengthen legal argumentation. |
