Abstract: Abstract:This study analyzes the legal reasoning contained in Judgment No. 17283-2020-01808, which declared the statute of limitations applicable to the sentence imposed for the crime of illegal possession and carrying of weapons, pursuant to the new interpretive criterion established by the Constitutional Court in Judgment No. 11-20-CN/21. The study focuses on analyzing the principle of penal favorability, the guarantee of due process, and the duty to provide legal reasoning as a fundamental pillar of the judicial function. Furthermore, it examines the roles of judicial and police officials in the execution of sentences, as well as the legal consequences arising from a failure to comply with these duties. This research demonstrates how robust, coherent judicial reasoning aligned with constitutional precedents ensures respect for the rights of the convicted person and reinforces legal certainty within the Ecuadorian criminal justice process.
